Privacy Policy

1. Scope of this Policy

This Policy covers the Website only.

Our platform, available separately at https://console.nixs.ai (the “Platform”), is provided to customers under a separate written agreement. How customer data is handled on the Platform is governed by that agreement and any associated data processing or confidentiality terms, not by this Policy. In relation to data that our customers process through the Platform, we generally act as a Data Processor acting on the instructions of the customer (who is the Data Fiduciary). This Policy does not describe those Platform arrangements.

2. What we collect on the Website

We have deliberately built the Website to collect as little personal data as possible.

a) Analytics data (no personal data, no cookies)

We use Plausible Analytics, which we host ourselves on our own server. Plausible is privacy-first and cookieless. It does not set cookies, does not collect or store personal data, does not create persistent identifiers, and does not track visitors across websites or over time. The aggregate, non-identifying information we look at includes things like page views, referring sources, approximate country, browser, and device type. Because this data is not personal data and is not shared with any third party, no consent banner or cookie notice is required to view the Website.

b) Information you choose to give us

If you contact us or submit an enquiry — for example through a “Get Started” or contact form, or by emailing us — we collect the information you provide, which may include your name, email address, company name, and the contents of your message. We use this only to respond to you, to follow up on your enquiry, and to discuss whether and how we might work together.

How form submissions are currently handled. At present, enquiry forms on the Website are processed using Google Forms, which acts as a processor on our behalf. This means the information you submit through a form is transmitted to and stored by Google on Google’s infrastructure, which may be located outside India, and is subject to Google’s own terms and privacy practices. We are in the process of moving form handling to our own infrastructure; this section will be updated when that change is made. You can always reach us directly by email at info@nixs.ai instead of using a form.

We do not sell personal data, and we do not use it for advertising or for automated profiling.

3. Why we process this information (purposes)

We process the limited information described above for the following purposes:

• to operate, maintain, and improve the Website;
• to understand, in aggregate, how the Website is used;
• to respond to enquiries and communicate with you about your request;
• to discuss potential engagements and provide information you ask for; and
• to comply with applicable law.

We will not use the information you give us for a new, unrelated purpose without telling you.

4. Legal basis and consent

For analytics, we rely on the fact that the data is non-personal and aggregate, so no consent is required.

For information you submit through a form or by email: by submitting an enquiry, you consent to our processing of that information for the purposes described in Section 3. You can withdraw your consent and ask us to stop processing or to delete your enquiry data at any time (see Section 7). Withdrawing consent does not affect the lawfulness of processing already carried out before the withdrawal.

5. Where your data is stored

The Website and our self-hosted analytics run on a server located in India. We do not transfer analytics or website data outside India for our own processing.

The one current exception is enquiry data submitted through our forms: as noted in Section 2(b), this is presently processed using Google Forms and may be stored by Google on infrastructure outside India. We rely on Google’s terms and security measures for that processing. Once we move form handling to our own infrastructure, this exception will no longer apply, and we will update this Policy accordingly.

6. How long we keep it

We keep enquiry and contact information only for as long as needed for the purpose it was collected, and typically no longer than 12 months after the last communication, unless an ongoing engagement results. If an enquiry does not lead to an ongoing relationship, we delete or anonymise the associated personal data once it is no longer needed or after the retention period described above, whichever is sooner. You may ask us to delete it sooner at any time.

Aggregate analytics data, which is not personal data, may be retained for trend analysis.

7. Your rights

Subject to applicable law, including DPDP, you have the right to:

• access the personal data we hold about you;
• correct or update inaccurate or incomplete data;
• request erasure of your personal data;
• withdraw consent you previously gave; and
• raise a grievance about how we handle your data.

To exercise any of these rights, or to ask a question about this Policy, contact us at info@nixs.ai. We will respond within a reasonable time and in accordance with applicable law. We may need to verify your identity before acting on a request.

8. Grievance redressal

If you have a concern or complaint about how we handle your personal data, please contact us at info@nixs.ai and we will work to resolve it. We will update this section with a named contact once our company is incorporated and our internal grievance process is formalised under DPDP.

If you are not satisfied with our response, DPDP provides for recourse to the Data Protection Board of India.

9. Security

We take reasonable technical and organisational measures to protect the information we hold, including access controls and security measures on the server infrastructure we operate. No method of transmission or storage is completely secure, but we work to protect your information and to respond promptly if a security incident affecting personal data occurs, including notifying affected individuals and authorities where required by law.

10. Children

The Website is intended for businesses and professional users and is not directed at children. We do not knowingly collect personal data of children through the Website.

11. Links to other sites

The Website may link to third-party sites or services that we do not control. This Policy does not apply to those sites, and we encourage you to review their privacy policies.

12. Changes to this Policy

We may update this Policy from time to time. When we do, we will revise the “Last updated” date above. Significant changes will be reflected on this page.
